Judicial Panel to Reconsider Decision That Permitted Former President to Deploy Military Forces to Portland

Judicial Panel Concurs to Reconsider Case

The federal appeals court ruled on this week that it would rehear the case concerning the president’s authority with an expanded group of 11 judges. The judicial body also overturned a previous ruling from a three-judge panel that had supported the federal government.

Ongoing Dispute Over Military Presence

This order represents the latest development in a long-running court case over whether the former president has the authority and valid reason to deploy state military units in Portland. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was initiated in due to ongoing demonstrations.

Differing Viewpoints

The administration has argued that federal officials at the ICE facility in south Portland were under attack, while city and state officials maintain that local officers have control of the situation.

Contrary to characterizations of Portland as a conflict zone, residents have been posting videos of scenic paths and a vibrant culinary culture, and organizing activities such as an protest bicycle event against the “militarization of our city”.

Court Proceedings

The Tuesday ruling came after a federal judge in Portland enacted two legal injunctions this month – one blocking the federalization of the state troops, and another prohibiting the use of any military personnel in Oregon, after attempts to circumvent the first order by calling up out-of-state forces.

On Monday, the appeals court had put the first ruling on hold – allowing command of state troops – but the second ruling remained in place, blocking the physical sending of the troops.

Full Panel Consideration

The latest ruling means the matter will be heard “en banc” – with all decisions under review together – by a group of 11 judges.

“This ruling shows that facts are important and that the courts are striving to ensure government responsibility. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a statement.

“The court is sending a clear message: the executive leader cannot send the armed forces into American urban areas without cause. We will continue protecting state legislation, values, and sovereignty as this legal proceeding progresses and our legal battle continues in the judicial system.”
